    New monitoring information available to KIUC and the Service on September 10, 2013, indicates that higher levels of take of listed species than anticipated and authorized in the HCP and the permit, respectively, are occurring due to covered activities. New information also indicates that the mitigation program being implemented under the HCP to address the impacts of the taking on covered species is less effective than anticipated. Given the new information discussed above, an amendment to the HCP is warranted to address the higher levels of take of covered seabirds caused by covered activities. The amendment should outline additional steps that KIUC proposes to further avoid, minimize, and mitigate the higher take levels. The Service formally advised KIUC of these findings in a letter, dated September 30, 2013. In light of the above new information, the Service is obligated to reinitiate formal consultation on our issuance of permit TE234201-0 pursuant to the requirements of section 402.16 of the implementing regulations for section 7 of the ESA to avoid jeoparding listed species or destroying or adversely modifying critical habitat. The outcome of that consultation will also inform the preparation of an amended HCP.
